City Extends The Temporary Moratorium on Eviction for Nonpayment of rent by Residential and Commercial Tenants Impacted by Covid-19 until July 31, 2020
On March 20, 2020, the City issued a temporary moratorium on eviction for nonpayment of rent by residential and commercial tenants impacted by the COVID-19 pandemic through May 31, 2020. The City has now extended this moratorium until July 31, 2020. Following State guidelines, the moratorium limits on a temporary basis any landlord’s ability to carry out evictions on any residential (including mobile homes and mobile home lots) or commercial property within the City of Marina for reasons related to COVID-19 impacts through July 31, 2020.
The moratorium prevents evictions if eviction is due to:
- nonpayment of rent or a foreclosure arising out of a substantial decrease in household or business income, including but not limited to, a substantial decrease in household income caused by layoffs or a reduction in the number of compensable hours of work, or a substantial decrease in business income caused by a reduction in opening hours or consumer demand, or substantial out-of-pocket medical expenses; and
- the decrease in household income or business income or the out-of-pocket medical expenses as caused by the COVID-19 pandemic, or by any local, state, or federal government response to COVID-19, and is documented.
The Order does not relieve the tenant of the obligation to pay rent, nor restrict a landlord’s ability to recover rent due.
