Development Impact Fee Nexus Study and Adoption of New Public Facility Impact Fees

Overview

There are many development projects within the City of Marina.  This growth increases the need for public facilities and infrastructure to serve the demand created by new development.  To ensure that new growth pays a proportionate share of the needed expansions, the City assesses Development Impact Fees.

A Development Impact Fee Nexus Study is required to establish and collect these fees.  The study establishes a nexus between the fee and the development impact.  The fees collected can only be used for their intended purpose; and cannot be used for routine maintenance or salaries.  The City retains all impact fees in a separate Public Facility Impact Fee Fund.  The revenues remain in this fund until the City Council takes formal action to allocate them to an applicable capital improvement project.

 

Authority for Development Impact Fees

In California, the Mitigation Fee Act, Section 66000 et seq. of the Government Code and the Marina Municipal Code, Chapter 3.26 Mitigation Fees for New Development provide a mechanism whereby the City may impose and charge mitigation fees as a condition of approval for development projects.  These mitigation fees can only be used to offset the cost of certain infrastructure attributable to development.

 

City of Marina Impact Fees

The City’s Development Impact Fees consist of the following public facility impact fee programs:

  • Public building facilities
  • Public safety facilities
  • Roadways
  • Intersections
  • Parks

In 2007, the City contracted with Kimley Horn to conduct a Development Impact Fee Study.  Following this study, the Council adopted public facility impact fees (PFIF).  In 2011, and subsequently in 2016, the Development Impact Fee Study was updated and the City Council adopted updated public facility fees.  Since 2016, the City has updated the Development Impact Fees based on the Engineering News Record (ENR) Construction Cost Index Value to reflect inflation.

The City recently contracted with a consulting team to provide an update to the prior impact fee studies through a Development Impact Fee Nexus Study.  A Public Hearing will take place on the following date and time for the Council to consider adopting the Study and updating all five (5) public facility impact fees.  This item was originally scheduled to be heard on July 1, 2025, then changed to August 6, 2025; however, it will be continued to the following date and time:

Developers that have Disposition and Development Agreements (DDA) which include terms related to Development Impact Fees, will be subject to fees in accordance with such agreement.
